AN ORDINANCE CREATING THE MUNICIPAL ECONOMIC ENTERPRISE OFFICE (MEEO) FOR THE PURPOSE OF ESTABLISHING, DEVELOPING, OPERATING, MAINTAINING AND MANAGING SUSTAINABLE MUNICIPAL ENTERPRISES TO ENHANCE THE INCOME  OF THE MUNICIPALITY

“WHEREAS, consistent with local autonomy and decentralization as mandated under R.A. No. 7160 also known as the Local Government Code of 1991, Local Government Units shall endeavor to be self reliant and shall exercise such powers and discharge such other functions and responsibilities for the provision of basic services and facilities;

WHEREAS, Section 76 of the local Government Code provides that “Every Local Government Unit shall design and implement its own organizational structure and staffing pattern taking into consideration its service requirements and financial capability, subject to the minimum standards and guidelines prescribed by the Civil Service Commission”;

WHEREAS, Section 443 (c) of the Local Government Code likewise provides that: “The Sangguniang Bayan may: (1) maintain existing offices not mentioned in subsection (a) and (b) hereof (mandatory and optional position); (2) create such other offices as may be necessary to carry out the purposes of the municipal government; or (3) consolidate the functions of any office with those of another in the interest of efficiency and economy”;

WHEREAS, under Section 447 (vii) of the Local Government Code, it is the responsibility of the Sangguniang Bayan to determine the powers and duties of officials and employees of the Municipality subject to the relevant provisions of the Code;

WHEREAS, Section 447 (viii) empowers the Sangguniang Bayan to determine the positions and salaries, wages, allowances and other emoluments and benefits of the officials and employees paid wholly or mainly from municipal funds and provide for expenditures necessary for the proper conduct of programs, projects, services, and activities of the municipal government;

WHEREAS, the creation of the Municipal Economic Enterprise Office (MEEO) aims to establish, develop, operate, maintain and manage sustainable municipal economic enterprises to generate revenue and enhance the delivery of public services pursuant to the economic and social objectives of the municipality;

WHEREAS, in consonance with Section 22 (d) of the Local Government Code, the municipality shall enjoy full autonomy in the exercise of their propriety functions and in the management of their economic enterprises, there is a needs to restructure and streamline the organization and management of municipal economic enterprises for purposes of optimizing human and physical resources for an efficient, effective pursuit of the LGU’ s objectives;

NOW, THEREFORE, on motion of Hon. Orlando Paulma and jointly seconded by Hon. Santos Niñonuevo, Hon. Raul Facon, Hon. Suzita Go and Hon. Serafin Monteclaro; 

BE IT ORDAINED, by the Sangguniang Bayan, in session assembled that:

ARTICLE I
CREATION OF THE MUNICIPAL ECONOMIC ENTERPRISE OFFICE, ITS FUNCTIONS, ORGANIZATIONAL STRUCTURE AND STAFFING PATTERN

Section 1. Creation of the Municipal Economic Enterprise Office

A.     The Municipal Economic Enterprise Office is hereby created as one of the line function departments of the Local Government Unit of Miagao, Iloilo with eight (8) major enterprise units and four (4) support services units, viz:

1.    Market Management
2.    Abattoir and Meat Inspection Service
3.    Parking and PUV Terminal Management
4.    Cemetery Management
5.    Sports, Recreation and Cultural Centers Unit
6.    Fish Port Services
7.    Operation of Secondary Growth Centers
8.    Tourism Promotion and Tour Packaging Service
9.    Administrative Services
10.    Research Planning and Development Unit
11.    Maintenance Unit
12.    Revenue Collection Unit

Section 2. The Municipal Economic Enterprise Units

A.    Market Management

The Market Management Unit shall take charge of the overall management of public markets pursuant to the provisions of the Municipal Investment Code, other laws, policies prescribed by the Municipal Market Committee and other duly constituted bodies.

It shall manage the market as a viable income generating facility of the LGU cognizant of the interests of the producers, the business locators, the consumers, and the public in general.
B.    Abattoir and Meat Inspection Service

The Abattoir and Meat Inspection Service Unit shall take charge of the operations of the Municipal Abattoir pursuant to Republic Act 9296, also known as the Meat Inspection Code of the Philippines, and other laws and regulations that may be duly promulgated thereafter.

C.    Parking Management

The Parking Management Unit shall take charge of the overall operations of the municipal streets used as parking areas. The requirement of fees, regulations and operations shall conform with the municipal ordinance and other issuances to that effect.

D.    Cemetery Management

Cemetery Management Unit shall take charge of the management of all public cemeteries operated and owned by the Local Government Unit pursuant to the Municipal Cemetery Code and other laws and regulations that may be duly promulgated thereafter.

E.    Sports, Recreation and Cultural Facilities Unit

The Sports, Recreation and Cultural Facilities Unit shall take charge of the management and maintenance of the Justice Ramon B. Britanico Hall, multi-purpose court, covered court and other sports, recreation and cultural centers owned by the municipal government.  It shall keep the record of all bookings for the use or rental of the said premises to include facilities and equipment therein, like the air-conditioned rooms. It shall likewise maintain the cleanliness and sanitation of the buildings and premises.

F.    Fish Port Services

The Miagao Wharf located at Barangay Kirayan Sur shall be operated as the municipality’s fish port area. It shall cater to commercial fishing vessels and transport vessels docking in Miagao.
G.    Operation of Secondary Growth Centers

The operation and coordination of established secondary growth centers shall be under the control and supervision of the LGU. It shall serve as the expansion of the town’s service and business areas primarily introduced to enhance the town’s economy.

H.    Tourism Promotion and Tour Packaging Service

The Tourism Promotion and Tour Packaging Unit shall develop tour packages for foreign and domestic tourists. It shall showcase the municipality’s local products and places of interest to include experiences on industrial activities and the way of life of Miagawanons. Souvenir products shall be one of the sources of income handled by the unit.

Section 3. Support Service Units

A.    Administrative Services

The Administrative Services Unit shall function as administrative support to the MEEO in supervising over all units of the department. The unit shall be directly supervised by the duly appointed Department Head. It shall take charge of all staff functions including but not exclusive to the conduct of monitoring of all other units in the department, the flow of information from among units and from outside of the department. The unit shall prepare the necessary report to be submitted by the department of the Local Chief Executive and other agencies.

B.    Research Planning and Development Unit

The Research Planning and Development Unit shall be the technical arm of the MEEO. It shall create plans and strategies to enhance the viability of existing enterprises, as well as develop new enterprises that shall generate income for the LGU and services to constituents.

C.    Maintenance Unit

The Maintenance Unit shall be comprised of personnel whose functions are related to the maintenance of facilities and equipment and other utility work. The unit shall conduct regular maintenance check of the facilities, equipment and other property under the department’s jurisdiction.

The Maintenance Unit shall determine the personnel requirement for each property or facility of the department and shall have immediate supervision over these personnel and their activities.

The Maintenance Unit shall come up with periodic assessment and report of all manpower and material requirement related to maintenance and submit the same to the MEEO.

D.    Revenue Collection Unit

The Revenue Collection Unit shall be comprised of personnel whose jobs are related to the collection of revenue from Municipal Economic Enterprises. All personnel detailed from the Municipal Treasurer’s Office as collection agents shall be under the direct supervision of the MEEO while performing functions within the office. The personnel however, shall remain under the administrative control of the Municipal Treasurer’s Office particularly in the accounting and remittance of money collected as well as other activities and functions of the Municipal Treasurer’s Office as prescribed by pertinent laws shall be maintained.

The Revenue Collection Unit shall keep record of payments and collection on a daily basis and submit periodic report to the MEEO and the MTO following protocols of reporting of each department.

The Revenue Collection Unit shall determine the personnel requirement in every collection posts and shall assign these personnel based on economic practicability and sound personnel management.

Section 4. Powers and Functions of the Municipal Economic Enterprise Officer (MEEO)

The MEEO shall exercise the following powers and functions:

a.    Exercise coordinate managerial control over the operations of various economic enterprise unit as well as its support services units.

b.    Advise the Municipal Mayor, the Municipal Market Committee, and other special bodies that may thereafter be legally constituted, on all matters involving economic enterprises and development.

c.    Develop policies and formulate rules and regulations, standards and procedures to improve and enhance revenue generation based on sound financial concept and principles for adequate delivery of services, subject to the approval of the Sangguniang Bayan.

d.    Prepare the annual budget of each Economic Enterprise and the Department as a whole.

e.    Exercise management and supervision over all units and personnel under the Municipal Economic Enterprise Office (MEEO).

f.    Exercise such other powers and perform such other duties and function as may be prescribed by law or ordinance incidental and necessary to this position.

Section 5. Municipal Economic Enterprise Office Functional Structure

The Municipal Economic Enterprise Office (MEEO) shall function according to the structure reflected in the hereto attached Annex “A” made an integral part of this Ordinance.

Section 6. Staffing Pattern and Creation of Plantilla Positions

To achieve an effective and efficient functioning of the Municipal Economic Enterprise Office (MEEO) pursuant to its objectives, the following plantilla positions are hereby created:

6.1.    An initial plantilla of the MEEO listed hereunder is hereby approved and adopted under this Ordinance. Additional positions may be added later based on the need for such positions following standard government procedure.

6.2.    Pursuant to the foregoing plantilla, existing positions currently filled-up shall form part of the MEEO staffing pattern. Other positions currently not existing are deemed created by virtue of this Ordinance except those positions that will be supplied via transfer of positions from other department or office. All positions created and transferred into the MEEO shall be allocated the corresponding budget.

6.3.    Personnel holding position from other department or office but currently detailed or working at the Municipal Economic Enterprise Office as well as those whose position are effectively transferred to the MEEO through this ordinance shall be issued Executive Orders by the Local Chief Executive detailing them into the MEEO upon effectivity of this ordinance. The said position as well as others that may be considered for lateral transfer from other offices into the MEEO is hereby declared transferred to the MEEO including its budgetary allocations.

ARTICLE II
FINANCIAL OPERATIONS

Section 1. Creation of Special Accounts for Municipal Economic Enterprise Office

A separate account for every unit of the Municipal Economic Enterprise Office is hereby authorized by the Sangguniang Bayan pursuant to Section 313 of the Local Government Code.

Profit or income derived from the operation of public utilities and other economic enterprises, after deduction of the cost of improvement, repair and other related expenses of the public utility or economic enterprise concerned, shall first be applied for return of advances or loans made therefore. Any excess shall form part of the general fund of the local government unit.

Section 2. The Municipal Economic Enterprise Office Budget

The Municipal Economic Enterprise Office shall prepare a budget separate from the general fund subject to the usual budgetary process.

Section 3. Funding Requirements

The funding requirements of the economic enterprises shall be sourced from their respective operating income or user’s fees. In the event that the income of the economic enterprise is insufficient to fund its financial requirements, the deficiency shall be sourced from the General Fund as subsidy.

The Capital Outlay of the economic enterprise units shall be treated as investments and part of the development project of the local government unit and may be charged to the twenty percent (20%) Development Fund.
Section 4. Charges, Rates and User Fees

Charges, rates, and user fees shall be based upon the duly enacted Revenue Code of the local government unit and other ordinances pertinent thereto that may thereafter be promulgated.

ARTICLE III
FINAL PROVISIONS

Section 1. Automatic Transfer of Budgetary Allocation

All budgetary allocations of every position transferred in or detailed from various offices are deemed transferred to the Municipal Economic Enterprises Office from the effectivity of this Ordinance.

Section 2. Personnel Transition

To effect the transfer of personnel from other departments to the MEEO, affected employees shall be reappointed by the Local Chief Executive pursuant to Civil Service Rules and Regulations.

All personnel movements shall conform to Section 235 of R.A. No. 7160, otherwise known as the Local Government Code of 1991.

Section 3. Repealing Clause

All ordinances, resolution, orders and decrees or parts thereof which are inconsistent with any provision of this Ordinance are hereby repeated or modified accordingly.

Section 4. Separability Clause

If, for any reason or reasons any part or provision of this Ordinance is held to be unconstitutional or invalid, other parts or provisions hereof that are not affected shall continue to be in full force and effect.

Section 5. Effectivity Clause

This ordinance shall take effect after ten (10) days of its posting in the bulletin boards of the Sangguniang Bayan of Miagao and at the entrance of the municipal building and at least one (1) other conspicuous place in the municipality.
